Access to and use of the Website, or any of its associated Services, is provided by Curfex (HK) Limited and Curfex Japan, Inc. (together termed 'Curfex'). Please read these terms and conditions (the 'Terms') carefully.

Upon acceptance of the Terms, you also agree to the exchange of information with Curfex by electromagnetic means by way of either email or notification on our Website.
In order to access the Services, you must first register for a customer account through the Website (the 'Account'). You must be at least 18 years old, and a resident of Japan to be eligible.
Upon completion of the account registration procedures, you will be a registered member of the Website ('Member').
When requesting for Services ('Instruction'), you must provide us with all relevant information as requested on the Website. This information requested are in line with the regulatory requirements that govern our Services. It is your responsibility to ensure that the information provided in the Instruction is accurate and complete. In the event that incorrect payee details were provided in the Instruction, we shall reasonably assist you in the recovery of your payment. We shall not be liable for any losses you incur.
Upon receiving your Instruction, we shall provide you with a quote. The exchange rate offered in the quote shall be valid for 24 hours. We will proceed with the fulfillment of Services ('Payment') after receiving the cleared funds required for the transfer ('Transfer Amount'), which includes our Services fees. In the event where the Transfer Amount is only available after this period, Curfex will not be able to offer the quoted rate. We will proceed with Payment at the exchange rate at receipt of the Transfer Amount or we will email you to ask if you want to proceed with your transaction. The revised quote will be sent to your email and will also be made available in your Account on the Website.
We will do our best to honor the exchange rate provided in the quote. In the event that there’s a 2% or more change in exchange rate in the 24 hours validity period, we reserve the rights to update the exchange rate and provide you with a revised quote or cancel your Instructions and refund any related cleared funds to you.
If the Instruction is received after 5 pm JST on a business day or not on a business day, the Instruction will be deemed to have been received on the next business day.
The Instruction would be cancelled after two (2) business days from date of Instruction receipt should Curfex not receive the cleared funds required to carry it out. A cancellation email will be sent to you and your Account on Website will be updated.
Any requests for cancellation of Payment is only possible if Payment has not been processed. In the event where Payment has been processed, we shall not be liable to provide a refund or any losses you may incur.
We reserve the rights to refuse your Instruction where:
Within two (2) business day of Payment, a Transfer Complete will be sent to your email and made available on your Account on the Website. This is for your record keeping purposes and concludes the Services for the Instructions provided. Such Transfer Complete confirmation by us is made on a best effort basis. Shall there be any discrepancies, Curfex shall not be held liable in any means.
You will be able to access and review your transaction history on your Account on the Website.
As a Member, you agree to comply with the following:
Payment for the Services (the 'Services Fee') shall be borne by you and made available to us with the Transfer Amount.
You acknowledge and agree that where Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Services Fee. We also reserve the rights to refuse Payment until receipt of Services Fees.
You agree and acknowledge that Curfex can change the Services Fee at any time.
We will only provide you with a refund of the Services Fee in the event we are unable to continue to provide the Services or at our absolute discretion, that it is reasonable to do so under the circumstances.
The Website, the Services and all of the related products are owned or controlled and reserved by Curfex.
All trademarks, service marks and trade names are owned, registered and/or licensed by Curfex, who grants to you a worldwide, non-exclusive, royalty-free, revocable license whilst you are a Member to:

If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sort).
A party to the Terms claiming a dispute ('Dispute') has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.
On receipt of that notice ('Notice') by that other party, the parties to the Terms ('Parties') must:

The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a pre-condition to the mediation commencing. All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.
Termination of Mediation.
If a reasonable period of time has elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.
Any dispute arising out of or in connection with the Terms shall be resolved by the Parties through mutual good faith consultation, failing which the same shall be referred and governed by the jurisdiction of Japan. The Tokyo District Court shall have the exclusive jurisdiction to hear any litigation between Parties at the first instance.
If any part of these Terms is found to be unenforceable by a Court of law, that part will be enforced to the maximum extent permissible under the applicable law. The remainder of the Terms shall remain in full force and effect.
1.1. Curfex Japan Inc. (hereinafter referred to as the “The Company”) is a Funds Transfer Service Provider that provides overseas funds transfer services (hereinafter referred to as "The Service"). The Service provided is different from foreign exchange transactions conducted by banks, etc.
1.2. The Company does not accept deposits, savings, time deposits, etc. (meaning time deposits, etc. as stipulated in Article 2, Paragraph 4 of the Banking Act) through this service.
1.3. The Service does not accept payment from insurance prescribed in Article 53 of the Deposit Insurance Act or Article 55 of the Agriculture and Fisheries Cooperative Savings Insurance Law.
1.4. The customers of the Service are protected by the ‘Security Deposits for Providing Funds Transfer Services’ that has been established as required by the Payment Services Act. The ‘Security Deposits for Providing Funds Transfer Services’ are to protect customers’ funds, in the event that the Company goes bankrupt.
1.5. Based on the procedure for the execution of right set forth in Payment Services Act, the customer of the service shall reserve the rights to a refund from the 'Security Deposits for Providing Funds Transfer Services' until the amount that is deposited for the Service is completed ie. The beneficiary has received the funds as requested.
2.1. Standard completion period
The standard performance period to complete the funds transfer to the beneficiary account depends on the country that the beneficiary's bank is located, generally, the completion date will be the next banking business day (except where deposits of funds are received by the Company after 15:00). However, the completion date might be delayed if additional documents are required. The standard completion period shall be displayed on the screen when customer confirms a funds transfer request.
2.2. Service Fee
For each funds transfer transaction, 1% of the transferred amount (rounded up to the nearest Japanese Yen) shall be paid as processing fee for the service. The actual service fee will be displayed on screen in our website when you request a funds transfer. In addition, you will be charged a transfer fee in the event of a refund.
2.3. Maximum amount of funds transfer handled

2.4. Currency conversion
The company uses the exchange rate determined by the Company in calculating the transfer amount and/or the received amount. The exchange rate shall be the mid-point rate provided by xe.com, calculated at the time of the remittance transaction request. However, the method of determining the exchange rate may differ depending on the country and currency. We shall not be responsible for any reductions in amount received that are due to the changes in the foreign exchange market.
2.5. Contract Period
The contract period for customers who registered for the service is 1 year. At expiration of the contract, the contract shall be renewed automatically for another year, unless the customer requests to terminate the contract.
2.6. Termination of contract in the contract period
There will be no termination fees charged when the customer requests to terminate the contract.
2.7. Process to check the status of funds in relation to funds transfer
Customer who has completed their member registration and requested for funds transfers can check the funds transfer status on the 'transaction confirmation' page.
2.8. Password and security matters
To use the Service, customers will require a customer ID and password. The customer shall strictly manage their customer ID and password at their own risk and should not share these information with any 3rd party. The Company shall not be liable for any damage arising from the customer disclosing their customer ID and password to a third party.

3.1. We will respond to complaints or consultations regarding our money transfer business in good faith as follows, based on our prescribed rules.
3.2. Besides the customer himself, the customer's heir or his / her representative may file a complaint in relation to our money transfer business.
3.3. Customer can file a complaint regarding our fund transfer business at our customer consultation desk. We will respond honestly even if it is not clear whether your complaint is related to our money transfer business.
3.4. In accordance with the nature of complaints from customers, the division will report such complaints to the Representative Director and the Board of Directors and respond appropriately.
3.5. The Company's Business Department shall promptly report the status of response to customer complaints, etc., to the Representative Director and the Board of Directors, and if necessary, give instruction to the Risk Management Department to investigate and take necessary measures to prevent the recurrence of the same issue based on the findings.
3.6. The Company's Risk Management Department regularly verifies the status of responses to customer complaints, etc., and reviews the organizational structure, etc. if necessary.
